A traffic ticket is no joke. Many people think that paying the fine gets rid of the charge. This is not the case. Paying the fine is pleading guilty to the charge and getting yourself a conviction on your driving record, which causes your insurance to go up, whether or not the charge included demerit points(see below). Many insurance companies consider the amount of tickets, and not the amount of points or in some cases the severity of the violation, so making sure you give yourself the best chance to get your ticket removed is an important step in saving you thousands of dollars, let alone suspensions and other consequences depending on what you were charged with. In specific situations {See Criminal Tab}Impaired Driving,Dangerous Driving, etc., can even land you in jail, and leave you with a criminal record. We work with a network of trusted and talented paralegals, lawyers and law firms to get your criminal matter handled the best possible way.

Under the Provincial Offences Act (POA) Part 1 Offences are when the Officer gives you a Certificate of Offence (Ticket) for an offence that is considered a less serious violation-although the penalties can be as bad as it is for Careless Driving under Part One which is $490.00, 6 demerit points and a huge hike in insurance rates (if they choose to keep you on the policy). The maximum fine on a Part One Offence is up to $1000, with no prison time. Examples of some Part One Offences include but are not limited to

  • Speeding,
  • Failure to Carry Drivers License,
  • Failure to Stop at a Red Light,
  • Using Handheld Device (e.g. phone),
  • Following Too Closely
  • Failure to Stop at a Stop Sign,
  • Careless Driving.

Any Part One Offence can be turned into a Part 3 Offence (occasionally), making it a more serious offence, where the penalties can be as bad as suspending your license for 2 years, 6 months of jail time, and up to $25,000 fines  (plus surcharge) for a first offence.

There are cases in which some offences can only be a Part 3 Offence, such as

  • Fail to Remain at the Scene of an Accident;
  • Stunt Driving;
  • Driving While Under Suspension;
  • Fail to Stop for Officer;
  • Driving without Insurance/Permit Drive No Insurance, etc.

You will know if it is a Part 3 Offence if you get a Commencement of Proceeding by Information (Summons to appear in court at specified time and place).
